R v VON EINEM 1984 - 'Abbreviated' Mervyn Joseph Martin XN
Q. Are you the State Manager for Pipeline Supplies of Australia?
A. I am.
Q. Are the work premises situated at 545 South Road Regency Park.
A. Yes they are.
Q. Was Mr Von Einem employed in your firm?
A. That’s right.
Q. In what position was he employed?
A. As accountant.
Q. Did his duties involve the maintaining of sick records of employees of the firm?
A. Yes.
Q. Including his own sick records.
A. Yes.
Q. Can you take us to June 1983. Where he was given a doctors certificate for a week in June. Was he off work from 6 June for a week?
A. That’s right.
Q. The following Monday was 13 June and that was the Queen’s birthday holiday.
A. That’s right.
Q. Did Mr Von Einem return to work on Tuesday 14 June 1983?
A. That’s right he did he still wasn’t well.
Q. The entries relating to missing days 6,7,8,9, and 10 June 1983, he gave a doctors certificate. When he returned to work would he just attach that to his file or show it to someone?
A. I would have signed that.
Q. Between that date, 14 June - first day back after the long weekend and in addition Monday 25 July, up until then, there are no missing days off work.
A. I can only refer to the records.
Q. Do you have an employee called Lynn Pratt?
A. Yes.
Q. Do you recall here in that week that he was absent from work taking his pay?
A. Yes. She went with another employee and she came back and said he was ill in bed.
Q. What day of the week is pay day
A. He was on a monthly salary so I think it would have been the Wednesday or Thursday.
Q. In that week of the 6th, do you recall being notified of his illness and missing work during that week?
A. Yes his mother rang me on the Monday which would have been the 7th.
Q. The 6th.
A. Anyway it was a Monday. His mother rang and said he was going to the doctor.
